Details on the proposal to amend the Codes, Covenants & Restrictions for the homes of Bent Tree West Phase 1.
What are you asking me to do?
The volunteers of the Architectural Review Committee and the Bent Tree West HOA encourage you to vote YES for updating the current Codes, Covenants and Restrictions to
-
- allow for CCR updates on an annual basis AND
- with a 66% vote for approval of the residents in Phase 1.
All homeowners are bound to the CCRs set forth when the neighborhood was formed whether you choose to support the Bent Tree West HOA financially or not.
Why should I vote YES?
For one, updating the CCRs to be reviewed and amended more frequently than only every 10 years is a benefit of the homeowners. Our current CCRs don't allow timely updates consistent with the changing times. Based on the current stipulations, we are only allowed to update the CCRs for Phase 1 at ten year intervals AND with a 75% vote of approval. As a result of the 10 year interval, previous attempts to make good changes got lost because too many changes were bundled into the proposed changes and then another 10 years went by.
Did you know that Phase 1 CCRs were set forth in 1975? They have not been updated for nearly 50 years! More frequent intervals allow for single issues to be proposed to the neighborhood in a more timely manner.
Did you know that the Architectural Review Committee's hands are currently tied to approve homeowners proposals for home improvements that the City of Dallas accepts? Based on current CCRs, they can't say 'yes' to such common things like using composition roof shingles, installing certain metal fences and gates, accepting 8-foot fence heights & horizontal fence planks, or placing sheds and pergolas on your property. Conflicting rules means a lot of time is spent explaining the policies and often creating animosities versus developing a sense of community and enthusiasm to improve the neighborhood. We all know most homeowners only desire to improve property values rather than decrease them and the ARC and the HOA want to get behind that too.
Who is affected by the change?
The 205 homes in Phase 1 of Bent Tree West are affected. Only those in this phase are allowed to vote on this measure. Please be aware that the proposed amendments will apply to all Phase 1 homeowners, regardless of membership in the Bent Tree West Homeowners’ Association. Therefore, all current Phase 1 homeowners are entitled and encouraged to vote.
What is the proposal changing?
This proposal will move to
1) Remove the 10 year cadence requirement.
2) Update the voting approval percentage from 75% to 66% of households in Phase 1.
