NOTICE TO HOMEOWNERS ADJACENT TO THE BTW PERIMETER WALL

The perimeter wall surrounding BTW was built by the developer to distinguish BTW from the surrounding neighborhoods. The planners directed that the maintenance of the wall would be provided by the homeowners whose property is adjacent to the wall. This provision is written into the deed of each lot. By definition, the homeowner’s lot runs under the alley up to, and including, the wall. The alley pavement is maintained by the City of Dallas.


There have been several accidents, mostly involving vehicular traffic, in which segments of the wall were destroyed. In each case, the homeowner adjacent to that portion of the wall was responsible for repairing the damage. The BTWHOA assists the homeowner by supplying the names of contractors who are able to make such repairs.


If you are unable to locate the drivers or the persons responsible for the accident, call the police at (214) 670-5424 to find out if a police report has been filed. If you can locate the driver, and he has insurance, a claim can be filed against his insurance company. A copy of the police report (if one was filed) will need to be included when filing the claim. The copy can be obtained by written request to: The Police Reports Division, 106 S. Harwood, Records Division #120, Dallas, TX 75201. The City charges $6 for the report.


The wall is now over 25 years old, and in the near future, maintenance will be required in most areas. The mortar may need to be replaced in selected spots and, where foundation problems arise, these will also have to be corrected.


Please review your closing papers and note that you are responsible for the repair and maintenance of the portion of the wall behind or to the side of your lot. Also remember that vines and other growth on the walls destroy the mortar, and roots of trees cause foundation problems. Lastly, if any mowing or trash removal is necessary inside the wall, it is your responsibility.

In order to reduce your potential financial exposure for wall repairs, you may wish to visit with your home insurance agent. We are told that limited coverage for damage caused by an auto accident can be obtained for a very reasonable premium.


BTWHOA is informing everyone of their responsibilities as set forth in the deeds to their property so that everyone will be prepared to do their part to maintain the appearance and structural integrity of the wall.
